1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legal agreement between you ("you" or "User") and Islomov Odilhon Rustamovich ("we", "us", or "our") governing your use of the MAP — Muslim Audio Player mobile application (the "App").
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the App and uninstall it from your device.
2. Description of the App
MAP is an Islamic audio player application that allows you to:
- Play audio files stored locally on your device.
- Stream online Quran radio stations.
- Organize your audio library with playlists and favorites.
- Customize your listening experience with an equalizer and audio visualizer.
- Access premium features through a one-time in-app purchase.
3. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet the eligibility requirements.
4. User Account
The App does not require you to create an account, register, or provide any personal information to use its features. No login or authentication is needed.
5. License and Usage Rights
5.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a compatible Android device that you own or control, solely for your personal, non-commercial purposes.
5.2 Restrictions
You agree not to:
- Copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App or any part of it.
- Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App, except to the extent expressly permitted by applicable law.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App.
- Use the App for any unlawful, harmful, or fraudulent purpose.
- Interfere with or disrupt the integrity or performance of the App or its related systems.
- Use automated systems, bots, or scripts to interact with the App.
- Attempt to bypass, circumvent, or disable any security features, including premium purchase verification.
6. Audio Content
6.1 Your Audio Files
The App plays audio files that are already stored on your device. You are solely responsible for ensuring that you have the legal right to possess and play any audio files accessed through the App. We do not host, distribute, upload, or provide any audio content.
6.2 Quran Radio Streams
The App provides access to online Quran radio streams hosted by third-party services. We do not own or control these streams and are not responsible for their availability, content, or quality. Stream availability may change without notice and is subject to the policies of the third-party providers.
6.3 No Content Liability
We make no representations or warranties regarding the accuracy, completeness, legality, or quality of any audio content played through the App, whether from local files or online streams.
7. Premium Features and In-App Purchases
7.1 Premium Upgrade
The App offers an optional one-time premium upgrade ("Premium") that unlocks additional features. Premium is a single, non-recurring in-app purchase processed through Google Play Billing.
7.2 Payment and Processing
All payment transactions are processed by Google Play. By making a purchase, you agree to Google Play's Terms of Service. We do not directly collect, process, or store your payment information.
7.3 Refund Policy
Refund requests are handled according to Google Play's refund policy. You may request a refund through Google Play within the applicable refund window. For issues beyond Google Play's standard refund process, you may contact us directly at odilhon1985@gmail.com and we will assess your request on a case-by-case basis.
7.4 Premium Entitlement
Your premium status is tied to your Google Play account. If you switch devices, you can restore your premium purchase by signing in with the same Google Play account and opening the App. We are not responsible for lost purchases due to Google account changes or issues outside our control.
8. Intellectual Property
The App, including its design, code, graphics, icons, user interface, and all related intellectual property, is owned by Islomov Odilhon Rustamovich and is protected by applicable copyright, trademark, and other intellectual property laws.
The name "MAP — Muslim Audio Player", the App's logo, and all associated branding are trademarks of Islomov Odilhon Rustamovich. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.
9. Third-Party Services
The App uses the following third-party services:
- Google Firebase — Analytics, Crashlytics, Cloud Messaging, Remote Config, and In-App Messaging
- Google Play Billing — In-app purchase processing
- Third-party radio stream providers — Online Quran radio stations
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The App will be uninterrupted, timely, secure, or error-free.
- The results obtained from using the App will be accurate or reliable.
- Any defects in the App will be corrected.
- The App will be compatible with all devices or operating system versions.
- Online radio streams will be available at all times.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ISLOMOV ODILHON RUSTAMOVICH, HIS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PREMIUM UPGRADE, OR FIVE US DOLLARS (USD $5.00), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Islomov Odilhon Rustamovich and his affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of the App.
- Your violation of these Terms.
- Your violation of any rights of a third party, including intellectual property rights related to audio content you play through the App.
13. Modifications to the App
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. We may also notify you of significant changes through the App or other means. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
15. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App is immediately revoked. You may terminate your use of the App at any time by uninstalling it from your device.
Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, warranty disclaimers, limitation of liability, and indemnification.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the Republic of Uzbekistan.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Islomov Odilhon Rustamovich regarding the use of the App, and supersede all prior or contemporaneous agreements, understandings, or representations.
